1. Agreement
These Terms of Use are a contract between you and Khristina Pastushenko for your use of Spot: GPS Tracker, including the Android app, website pages, onboarding flows, account tools, subscription features, content, software, and related support.
By downloading, accessing, purchasing, subscribing to, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What Spot Provides
Spot is a personal location sharing app. Depending on your device, permissions, plan, country, app version, and settings, the Service may include:
- live or recent GPS location sharing;
- family, group, or trusted-contact circles;
- route, trip, movement, or place history;
- arrival, departure, and geofence alerts;
- battery, connectivity, or device status signals;
- invitations, account settings, notifications, and support.
We may add, change, limit, or remove features when we improve the Service, respond to legal or platform requirements, protect users, or adjust our product offering.
3. Accounts and Eligibility
You need legal capacity to accept these Terms. If you create an account or purchase a subscription, you must provide accurate information and keep it current.
You are responsible for activity under your account, for keeping login credentials private, and for securing your device. Tell us promptly if you suspect unauthorized access or account misuse.
A child or dependent may use Spot only where permitted by law and with any required parent, guardian, or authorized adult consent. The adult who authorizes the use is responsible for supervision, lawful consent, group membership, and the child's or dependent's use of the Service.
4. Location Sharing Rules
Spot must be used openly and lawfully. You may share, view, or request another person's location only when that person knows about the sharing arrangement, has joined or accepted the relevant group or invitation, and has given any required consent and device permission.
You must not use Spot for:
- secret tracking, stalking, harassment, intimidation, coercion, or abuse;
- workforce monitoring, private investigation, law enforcement, or regulated tracking without written authorization from us and all legally required permissions;
- tracking a device or person when consent has been withdrawn;
- collecting, exporting, or disclosing another person's location or personal data without authorization.
Location information can be sensitive. You are responsible for understanding and following privacy, data protection, communications, employment, child protection, and other laws that apply to your use.
5. Subscriptions and Billing
| Plans | Some features may require a paid plan. Prices, billing periods, included features, trial details, and renewal terms are shown before purchase. |
|---|---|
| Renewal | Subscriptions may renew automatically unless canceled before the renewal deadline shown by the purchase channel. |
| Where to cancel | Cancel through the original purchase channel, such as Google Play, a website billing portal, Stripe, or another payment provider. |
| App deletion | Removing the app or deleting an account does not by itself cancel recurring billing handled by a platform or payment provider. |
If a trial is offered, the trial period, price after trial, and cancellation method will be displayed before you start. Unless the checkout says otherwise, a trial may convert into a paid subscription when the trial ends.
We may change future prices or plan features. When required by law or platform rules, we will give notice before a price change affects renewal.
Fees are generally non-refundable unless applicable law, Google Play policy, payment provider rules, or a specific offer says otherwise. Refund requests for platform purchases may need to be submitted to that platform.
Nothing in this section limits non-waivable consumer rights, including any statutory withdrawal rights available in the European Union, United Kingdom, or another applicable jurisdiction.
6. Acceptable Use
You agree that you will not:
- break the law or violate another person's rights;
- misrepresent your identity, create misleading accounts, or access another user's account;
- interfere with app security, subscription checks, or access controls;
- copy, scrape, harvest, sell, or disclose Service data without authorization;
- reverse engineer, decompile, or extract source code except where law expressly permits it;
- upload malware, overload infrastructure, or disrupt the Service;
- use Spot to build or train a competing product;
- submit unlawful, abusive, defamatory, hateful, misleading, or infringing content;
- rent, sell, sublicense, or commercially exploit the Service without our written consent.
We may investigate suspected misuse and may restrict features, remove content, block access, or suspend accounts where reasonably necessary to protect users, the Service, our providers, or legal rights.
7. Ownership
Spot, including software, interfaces, designs, text, graphics, logos, trademarks, features, and documentation, belongs to Khristina Pastushenko or our licensors. These Terms give you a personal, limited, revocable, non-transferable right to use the Service as intended.
You keep ownership of content you submit, such as support messages, profile images, or feedback. You give us the rights needed to host, display, process, troubleshoot, protect, and improve the Service. Feedback may be used without obligation to you.
8. Third Parties
Spot may rely on third-party platforms and tools, including Google Play, Google Play Billing, map and location providers, hosting services, analytics or diagnostics tools, push notification systems, authentication services, payment processors, and customer support tools.
Third-party services may have their own terms, privacy policies, outages, refund rules, security practices, and account requirements. We do not control those services and are not responsible for decisions or failures outside our control.
If you download the app through Google Play, Google Play rules may also apply to your download, billing, cancellation, and refund experience.
9. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, including location data.
We do not sell precise location data. We do not show third-party ads inside Spot, and we do not use precise location data to serve advertising.
10. Availability and Safety
Spot is not an emergency service. Do not rely on it as the only way to protect a person, find a person, respond to an emergency, or make safety-critical decisions. If someone may be in danger, contact appropriate emergency services or authorities immediately.
Location results, histories, routes, geofences, timestamps, alerts, battery information, and connectivity status may be delayed, incomplete, unavailable, or inaccurate because of GPS signal, network coverage, device hardware, permissions, battery settings, Android restrictions, app version, map data, user settings, or third-party infrastructure.
We work to keep Spot reliable, but we do not promise uninterrupted, error-free, real-time, or perfectly accurate service.
11. Liability
To the fullest extent allowed by law, the Service is provided "as is" and "as available". We disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.
To the fullest extent allowed by law, Khristina Pastushenko and its affiliates, personnel, contractors, licensors, service providers, platform providers, and payment providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, loss of goodwill, service interruption, unauthorized access, location inaccuracy, or misuse by users.
Where liability cannot be excluded, our aggregate liability for claims relating to the Service or these Terms will be limited to the amount you paid us for the Service during the three months before the claim, or EUR 50 if you paid nothing, unless applicable law requires a different amount.
Nothing in these Terms limits liability or consumer rights that cannot be limited by law, including liability for fraud, intentional misconduct, or death or personal injury where such limitation is prohibited.
You agree to indemnify Khristina Pastushenko against claims, losses, liabilities, damages, costs, and expenses arising from your unlawful use of the Service, violation of these Terms, misuse of location data, content you submit, or infringement of another person's rights.
12. Ending Access
You may stop using Spot at any time. You may request account deletion through available app or website tools, or by contacting operate@legaldocs.cc.
We may suspend or terminate access if we believe your account, device, content, payment, or use of the Service creates legal, security, operational, safety, fraud, abuse, or reputational risk.
Account deletion or termination does not cancel subscriptions handled by external billing channels. You must cancel through the purchase channel to stop future renewals.
Sections that by nature should continue after termination remain in effect, including ownership, privacy, payment obligations, disclaimers, liability limits, indemnity, law, and miscellaneous terms.
13. Law and Disputes
These Terms are governed by the laws of Cyprus, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence provide additional non-waivable rights.
Before starting a formal proceeding, please contact us so we can try to resolve the issue informally. If a dispute cannot be resolved informally, courts located in Cyprus will have jurisdiction unless applicable consumer law gives you the right to bring a claim elsewhere.
If any part of these Terms is found invalid or unenforceable, the remaining parts will continue to apply. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer these Terms as part of a merger, acquisition, restructuring, sale of assets, or similar business transaction.
We may update these Terms when the Service, laws, platform rules, payment flows, or business needs change. The effective date shows when the current version applies. If a change is material, we may provide additional notice as required by law.
